The story of how marijuana became illegal is rooted in racist fears and prejudices against Mexican immigrants around 1910.

Marijuana Prohibition

The marijuana prohibition began in the early 20th century and was largely sparked by two men. One was William Randolph Hearst who was the owner of various different newspapers across the country. The other was his good friend, Harry Anslinger, the first commissioner of the U.S. Treasury Department’s Federal Bureau of Narcotics.

These two men are almost entirely responsible for marijuana being illegal today.

How did they do it? Simple. Hearst practically invented “yellow journalism” or what we know it today as “fake news.” He would exaggerate stories having anything to do with marijuana usage as page one news. The Hearst newspapers were also linked to a smear campaign against hemp, which was used in paper production and became a competitor of wood-pulp paper.

Through a consistent campaign of sensationalism, along with Hearst’s good buddy campaigning against the evils of marijuana, they made false claims that shaped public opinion about pot. Anslinger used scare tactics to associate marijuana with Mexican immigrants and black people, calling it a “killer weed” and claiming it was turning America’s youth into criminals.

Eventually, public perception of marijuana hit an all-time low. Therefore, in 1937, Congress passed the Marijuana Tax Act, which effectively made it illegal to possess or sell weed.

Now that we know how marijuana became illegal let’s talk about what CBD actually is. With so much confusion around CBD, it can be easy to forget this plant-based substance is really just a naturally-occurring compound.

The reality is that marijuana prohibition exists to this day around certain parts of the country due to personal political reasons far more so than the dangers of the drug. Alcohol causes more death in our country every year than marijuana ever will.

Marijuana vs. Cannabinoids

Marijuana is the actual plant, but hemp and marijuana are both varieties of the Cannabis sativa L. plant. Plants are considered “cannabis” when they have more in common with marijuana than hemp — specifically, when they have high amounts of THC (Tetrahydrocannabinol) and low levels of CBD (Cannabidiol).

CBD is non-psychoactive, which means it won’t make you high. Instead, it has other health benefits that have been shown to reduce pain, improve anxiety and even improve sleep. THC is the psychoactive component of marijuana that causes the “high” feeling associated with the drug.

CBD vs. THC

When we think of marijuana today, we think of THC, the cannabinoid associated with getting high. However, CBD is often – unjustly – grouped into this category. In reality, CBD is unique from THC.

For one, THC is illegal on the federal level. Some states have legalized it for recreational or medicinal use, but it is still classified as a Schedule I drug by the DEA (Drug Enforcement Administration). CBD, on the other hand, is legal in all 50 states.

As discussed, CBD is a non-psychoactive cannabinoid found in cannabis. It has numerous health benefits that work with the human endocannabinoid system (ECS). ECS is a complex set of neurotransmitters that helps regulate mood, immune response, appetite, pain sensation and more.
